Welcome to the website www.haruhar.com, hereinafter referred to as the website, the terms and conditions presented apply from the moment you view the website and continue to use this website, either as a visitor or as a customer, and by purchasing the products offered, you implicitly express your acceptance and lack of reservations regarding these criteria.
The following terms will be defined and interpreted as follows:
Seller = HARUHUB S.R.L., with registered office at Strada Grigore Ionescu no. 63, block T73, Staircase 2, Floor 4, Apartment 42, Sector 2, Bucharest Buyer/Client = natural person/legal entity who places an order on the website www.haruhar.com;
Contract = all the provisions found in this section, which the Client accepts by placing an order. According to Law 365/2002 on electronic commerce, the contract is considered concluded when the acceptance of the contracting offer has been acknowledged by the offeror;
Terms and Conditions = provisions that regulate the contractual relations between visitors and users of the website and HARUHUB S.R.L. The Terms and Conditions may be modified and updated at any time;
Order = the Customer's intention to purchase HARU Har products. The order will acquire contractual value only upon acceptance by HARUHUB S.R.L by issuing a confirmation of processing and delivery;
Products = clothing items made from natural fabrics, made to order and personalized according to the Customer's requirements, sold by HARUHUB S.R.L; Products made to order and personalized according to the Customer's requirements = products that are made based on individual choices or the customer's decision;
Personal data = any information relating to a natural person/legal person who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to his/her physical, physiological, genetic, mental, economic, cultural or social identity;
Data processing = any operation or set of operations which is performed on personal data or on sets of personal data collected for the purpose of processing the order, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure;
Major force = external, unforeseeable and unavoidable event. Without being exhaustive, cases of major force include: wars, social unrest, floods, fires or landslides and any other natural calamities;
Intellectual Property = The entire content of this site and the site itself are protected by copyright, trademarks and all intellectual rights and applicable laws. No content or material presented here may be used, copied, distributed without the prior, express, written consent of HARUHUB S.R.L.. All rights are reserved, worldwide.
Users of the site www.haruhar.com are required to respect all copyrights and all related rights and any other intellectual property rights owned by HARUHUB S.R.L.
Personal data and confidentiality
HARUHUB S.R.L. collects personal data in compliance with the provisions of Regulation no. 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), applicable in all Member States of the European Union from 25.05.2018.
All your personal data is collected, stored and used in accordance with applicable law. Personal data is collected for billing purposes, as well as to improve and personalize your shopping experience on the website www.haruhar.com. All data provided as part of the registration process is stored and protected by applicable law.
Order placement and acceptance
All orders are subject to availability and acceptance. Items added to the shopping cart are not reserved and may be available for purchase by other customers. When you place an order, you will receive an email with the details of your order. This email does not constitute an acceptance of your order, but once your order is packed and ready for shipment, your order has been accepted and you will receive an order confirmation. If you do not receive the confirmation email from us, we apologize, but it means that there is a problem with the order and we cannot accept it. We reserve the right to refuse your order if we are unable to obtain payment authorization or if shipping restrictions apply to your country of residence.
Prices and Payments
Prices will be displayed including VAT for purchases within the EU.
Prices do not include shipping costs and customs duties that you may incur according to the applicable legislation in your country of residence. We use a Shopify payment processing service provider. Pay online with Visa or Mastercard, all securely through the Shopify payment processor. Card processing is done exclusively on Shopify servers. The security of your information is guaranteed by the fact that Shopify does not store your confidential card data, but sends it encrypted through a secure connection to the processing bank. In this way, your information is safe. When you choose to pay by credit card, your transaction will appear on your bank statements with haruhar.
Returns
Please note that the items present on the www.haruhar.com website are made to order, personalized and according to current legislation, cannot be returned.
Major force
Neither party shall be liable for the failure to perform contractual obligations if such failure is due to a case of force majeure.
Modification of the Terms and Conditions
HARUHUB S.R.L. reserves the right to modify, update the content of the website www.haruhar.com and the provisions contained in the Terms and Conditions, without prior notification to users or third parties.
Final provisions
These provisions are supplemented by Emergency Ordinance 34/2014 on consumer rights in contracts concluded with professionals, as well as for the amendment and completion of certain normative acts, Law No. 296/2004 on the Consumer Code, Law 365/2002 on electronic commerce.
